Welcome to Joyarti.
These Terms of Service govern your access to and use of Joyarti’s website, store, creative tools, AI-assisted features, product previews, saved designs, My Collection, Gift Finder, customer support, and custom product ordering services.
By accessing or using Joyarti, uploading content, saving a design, generating a preview, placing an order, or clicking to accept these Terms where prompted, you agree to these Terms.
Please read these Terms carefully.
1. Consumer Protection Rights
Nothing in these Terms, including our Shipping Policy, Refund Policy, Privacy Policy, or any other policy referenced here, is intended to exclude, restrict, or modify any rights or remedies you may have under applicable consumer protection laws.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use Joyarti.
If you use Joyarti on behalf of another person, business, or organization, you represent that you have authority to do so.
3. Accounts and Security
You may need an account to use certain features, save designs, access My Collection, or place orders.
You agree to provide accurate information and keep your account details secure.
You are responsible for activity under your account.
We may suspend or terminate accounts that violate these Terms or create legal, safety, fraud, payment, or platform-integrity concerns.
4. User Content
“User Content” means photos, images, reference materials, text prompts, descriptions, gift information, names, dates, messages, reviews, feedback, and other content you upload, submit, save, or provide to Joyarti.
You keep ownership of your User Content to the extent you own it.
By submitting User Content, you confirm that:

You own it or have permission to use it

It does not violate copyright, trademark, privacy, publicity, likeness, moral rights, or other rights

If it includes another person’s likeness, you have the necessary permission to use it for Joyarti’s services

If it includes a child, you are the child’s parent or guardian, or otherwise have the legal right to share the content for this purpose

It complies with these Terms and applicable law
5. License You Grant to Joyarti
You keep ownership of your User Content to the extent you own it.
We do not claim ownership of your private uploaded photos or original content.
To provide Joyarti’s services, you grant Joyarti and our service providers a non-exclusive, worldwide, royalty-free license to host, store, copy, reproduce, display, modify, adapt, process, transmit, and create derivative works from your User Content as reasonably needed to:

Generate artwork, previews, mockups, 3D model-related outputs, and recommendations

Adapt designs to different products, materials, shapes, and formats

Fulfill, produce, package, and ship your orders

Provide customer support, quality review, safety review, content review, fraud prevention, and policy enforcement

Save your designs, favorites, or My Collection items when available

Operate, maintain, secure, troubleshoot, and improve Joyarti’s services, subject to our Privacy Policy

Comply with law, legal process, and valid rights-holder requests
This license does not allow us to use your private uploaded photos, generated artworks, or custom designs in public advertising or public marketing without your permission.
6. AI-Assisted Features, Third-Party Providers, and Generated Outputs
Joyarti uses automated systems, including AI-assisted tools and creative workflows, to help transform photos, prompts, reference images, style choices, gift preferences, and product selections into artwork, previews, mockups, 3D model-related outputs, recommendations, and custom products.
Some AI-assisted features may be provided by or processed through third-party technology providers or AI-assisted processing providers.
Your inputs and outputs may be processed by those providers as needed to provide the feature, subject to our agreements with them and our Privacy Policy.
AI-assisted outputs may include creative variation.
Outputs may be inaccurate, incomplete, unexpected, offensive, unsuitable, or similar to outputs created for other users, especially when similar prompts, styles, products, or reference materials are used.
Joyarti does not guarantee that any generated output, style, composition, recommendation, or design direction will be unique, exclusive, copyrightable, registrable, or free from similar independently created works.
Previews are provided to help you understand the likely result, but they are not exact guarantees of the final physical product.
Color, scale, placement, cropping, material texture, surface finish, and product appearance may vary between screen previews and final items.
You are responsible for reviewing your inputs, uploaded files, generated previews, product selections, size choices, shipping address, and order details before placing an order.
7. Generated Outputs and Usage Rights
Subject to your ownership rights in your original User Content and Joyarti’s rights in its website, software, AI-assisted workflows, style systems, templates, product previews, design tools, branding, and other materials, you may use the final custom product and purchased output for personal, non-commercial purposes unless we expressly allow otherwise.
You may share photos or videos of your purchased Joyarti product on your personal social media accounts, provided that you do not misrepresent sponsorship, endorsement, affiliation, ownership of third-party rights, or the nature of any AI-assisted output. Commercial use, resale, brand use, paid promotional use, advertising use, or use in connection with a business, product, service, campaign, or marketplace listing may require separate permission or additional terms.
You may not use Joyarti-generated outputs, product previews, templates, style systems, design systems, workflows, or service features to create, train, benchmark, market, or support a competing service.
You may not claim that an AI-assisted output is entirely human-generated, a real photograph of an event that did not occur, or an official endorsement by a person, brand, team, organization, or public figure unless you have the rights and permissions to make that claim.
Joyarti does not provide legal advice and does not guarantee that any generated output can be copyrighted, trademarked, registered, used commercially, or used without obtaining additional rights or permissions from third parties.
8. Prohibited Content and Conduct
You may not upload, submit, request, generate, save, share, or order content that:

Infringes copyright, trademark, trade dress, privacy, publicity, likeness, moral rights, or other rights

Includes copyrighted characters, entertainment franchises, game characters, anime characters, branded artwork, or protected designs you do not have rights to use

Uses celebrity, athlete, public figure, influencer, creator, private-person, or child likeness without required permission

Includes sports team, league, school, company, organization, or brand names, logos, uniforms, or marks without authorization
-
Includes movie, TV, game, comic, social media, news, or other screenshots you do not have rights to use
-
Is unlawful, fraudulent, threatening, harassing, defamatory, hateful, discriminatory, obscene, exploitative, violent, or otherwise harmful
-
Sexualizes minors or depicts children in unsafe, exploitative, or inappropriate contexts
-
Creates, requests, or promotes non-consensual intimate imagery, sexual deepfakes, image-based abuse, or humiliation of private people
-
Impersonates another person, misleads people about identity, source, endorsement, sponsorship, or affiliation, or creates fake identity documents or deceptive evidence
-
Creates misleading endorsements, fake reviews, fake testimonials, counterfeit products, spam, malware, scams, or disinformation
-
Attempts to bypass safety filters, content protections, rate limits, security measures, or other service restrictions
-
Scrapes, extracts, reverse-engineers, or uses Joyarti content, previews, templates, outputs, or systems for AI training, benchmarking, or building a competing service
We may refuse, remove, hold, cancel, restrict, or suspend content, designs, orders, features, or accounts that we believe may violate these Terms, third-party rights, applicable law, or Joyarti’s safety, quality, or platform-integrity standards.
9. Content Review and Order Refusal
Joyarti may use automated tools, manual review, service-provider review, rights-holder reports, safety signals, fraud signals, or customer support review to help detect content that may be infringing, unsafe, unlawful, fraudulent, low-quality, technically unsuitable, or unsuitable for production.
We are not obligated to review all User Content, and review does not mean that Joyarti approves, endorses, or accepts legal responsibility for the content.
We may place an order on hold, request changes, cancel an order, refuse fulfillment, remove content, disable a design, limit access to a feature, or suspend or terminate an account when reasonably necessary.
If an order is canceled because of prohibited, infringing, unsafe, unlawful, fraudulent, technically unsuitable, or policy-violating content, refund eligibility may depend on the status of production, the nature of the issue, and applicable law.
10. Custom Products, Orders, and Payments
Joyarti products are made to order based on the content, product, style, size, color, material, and options you select.
Once production begins, orders may not be cancelable or changeable.
Prices, taxes, discounts, and shipping costs are shown at checkout.
By providing a payment method, you authorize Joyarti and its payment processors to charge the total amount due.
Product descriptions, images, mockups, availability, pricing, materials, features, promotions, discounts, taxes, shipping costs, and delivery estimates may change from time to time.
We may correct errors, inaccuracies, or omissions, including pricing, promotion, product description, product availability, shipping, tax, or checkout errors.
If an error affects your order, we may contact you for instructions, cancel the affected order or item, or provide another appropriate solution, subject to applicable law.
Payment must be authorized before we begin production or fulfillment.
If payment is declined, reversed, disputed, or charged back, we may suspend or cancel the affected order or account, subject to applicable law.
By placing an order, you confirm that you have reviewed and approved the product, design, preview, text, image, size, color, quantity, shipping address, and order details.
11. Shipping, Returns, and Refunds
Shipping timelines, return eligibility, and refund rules are described in our Shipping Policy and Refund Policy, which are incorporated into these Terms.
Because each item is made to order, we generally cannot offer refunds or exchanges for change of mind, user error, incorrect order details, or subjective creative preference after production begins.
If an item arrives damaged, defective, lost, or different from the order you placed, please contact us under our Refund Policy.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws.
12. Saved Designs, My Collection, and Account Content
Joyarti may allow you to save designs, generated results, product previews, favorites, or My Collection items.
These features are provided for convenience and may change over time.
Joyarti is not intended to be your only storage or backup service.
You should keep your own copies of important original photos, files, or designs.
If your account is closed, suspended, deleted, or inactive, you may lose access to saved designs or My Collection items, subject to applicable law and our Privacy Policy.
13. Gift Finder and Recommendations
Gift Finder, product recommendations, style suggestions, and related guidance are provided for convenience and inspiration.
They are not guarantees that a product, style, design, or gift will meet every personal preference or recipient expectation.
You are responsible for choosing the final product, design, size, style, and order details.
14. Joyarti Intellectual Property
Joyarti owns or licenses the website, software, AI-assisted workflows, style systems, templates, product previews, design tools, branding, text, graphics, logos, visual systems, recommendation systems, and other materials provided by Joyarti.
You may not copy, reproduce, distribute, modify, sell, license, scrape, reverse-engineer, extract, or use Joyarti’s intellectual property to build or assist a competing service.
You may not use Joyarti’s name, logo, branding, website content, product previews, templates, style systems, design systems, workflows, or other materials without permission.
Purchasing a Joyarti product does not give you ownership of Joyarti’s website, software, templates, style systems, design systems, workflows, previews, mockups, or brand materials.
15. Reviews, Feedback, Creator Content, and Marketing Permissions
We do not restrict your ability to leave honest reviews about your experience with Joyarti.
If you submit a review, testimonial, feedback, idea, or suggestion, we may use it to improve and promote Joyarti.
If we display reviews, testimonials, or creator content in marketing, we may edit for length, format, grammar, clarity, or display requirements, but we will not materially misrepresent the original meaning.
We do not buy, sell, create, or knowingly publish fake reviews or testimonials.
Reviews and testimonials must reflect honest experiences.
We do not provide compensation or incentives in exchange for reviews expressing a required positive or negative sentiment.
If a review, social post, creator video, testimonial, endorsement, or other content is sponsored, gifted, incentivized, affiliate-based, employee-related, or otherwise connected to Joyarti in a way that consumers may not reasonably expect, that connection must be clearly and conspicuously disclosed where required by law.
If you send us content for marketing use, tag us, respond to a permission request, or otherwise give us permission to share your content, you grant us permission to display that content in Joyarti marketing, social media, website, email, advertising, or related channels, subject to the scope of the permission you provide.
We will not use your private uploaded photos, generated artworks, or custom designs in public marketing without your permission.
16. DMCA and Intellectual Property Complaints
Joyarti respects intellectual property rights and expects users to do the same.
If you believe content on Joyarti infringes your copyright, please send us a written notice that includes:
• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the allegedly infringing material and where it is located
• Your name, address, telephone number, and email address
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

This address is for copyright and intellectual property notices only. It is not a return address. If a return is needed, we will provide the correct instructions by email.
If you believe your content was removed or disabled by mistake or misidentification, you may send us a counter-notification that includes your physical or electronic signature, identification of the material removed or disabled and where it appeared, a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification, your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, the judicial district in which Joyarti may be found, and that you will accept service of process from the person who submitted the original notice or that person’s agent.
We may forward notices, counter-notices, and related information to the affected user, rights holder, service providers, or others where appropriate.
Joyarti maintains and reasonably implements a repeat infringer policy. We may remove content, cancel orders, reject designs, suspend accounts, or terminate users who repeatedly violate intellectual property rights or whose content, designs, or orders are repeatedly subject to valid intellectual property complaints or removals. We may also take action after a single serious violation where appropriate.
For trademark, publicity, likeness, or other intellectual property complaints, please contact us with enough information to identify the rights at issue, the material involved, and the basis for your complaint.
17. Privacy
Your use of Joyarti is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, and retain personal information, including uploaded content, prompts, generated previews, generated outputs, order information, and related service data.
If there is a conflict between these Terms and the Privacy Policy regarding the collection, use, disclosure, or retention of personal information, the Privacy Policy controls.
18. Third-Party Services
Joyarti may use third-party providers for commerce, payment processing, fraud prevention, fulfillment, shipping, packaging, customer support, analytics, storage, AI-assisted processing, creative tools, safety review, email, advertising, and marketing.
Third-party websites, apps, platforms, or services may have their own terms and privacy policies.
Joyarti is not responsible for third-party services that we do not control, except where required by applicable law.
Some third-party services may process information in countries other than where you live.
19. Termination
You may stop using Joyarti at any time.
We may suspend or terminate access to the Services if we believe you have violated these Terms, created legal or safety risk, infringed third-party rights, abused the Services, used Joyarti in a fraudulent or harmful way, or created payment, security, or platform-integrity concerns.
Termination may affect your ability to access saved designs, My Collection items, generated previews, order history, or account features, subject to applicable law and our Privacy Policy.
Even after termination, certain sections of these Terms may continue to apply, including sections about User Content, Joyarti intellectual property, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and any other provisions that by their nature should survive termination.
20. Disclaimer of Warranties
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, Joyarti disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and exact accuracy of AI-assisted outputs, previews, product renderings, recommendations, or generated results.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or free of harmful components.
We do not guarantee that any AI-assisted output, recommendation, preview, mockup, design direction, style, product suggestion, or generated result will be unique, exclusive, copyrightable, registrable, commercially usable, or free from similar independently created works.
We do not guarantee that any product, design, style, preview, recommendation, or gift suggestion will meet every personal preference, recipient expectation, event need, or subjective creative expectation.
Nothing in this section limits any rights or remedies you may have under applicable consumer protection laws.
21. Limitation of Liability
To the maximum extent permitted by law, Joyarti will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
Joyarti’s total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.
We are generally not responsible for additional losses related to missed gifting dates, event deadlines, personal expectations, business losses, lost profits, lost data, or delays outside our reasonable control, except where required by applicable law.
Some jurisdictions do not allow certain exclusions or limitations, so some of these limits may not apply to you.
Nothing in this section limits any rights or remedies you may have under applicable consumer protection laws.
22. Indemnification
You agree to defend, indemnify, and hold harmless Joyarti and its affiliates, officers, employees, contractors, service providers, partners, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:

This indemnification obligation applies to the extent permitted by applicable law.
23. Dispute Resolution, Arbitration, and Class Action Waiver
Please read this section carefully. It affects how disputes between you and Joyarti may be resolved.
You and Joyarti agree to try to resolve any dispute informally first. Before starting arbitration or a court claim, the party raising the dispute must send written notice describing the issue and the requested resolution.
If the dispute is not resolved informally, any dispute arising from or relating to these Terms, the Services, your order, or your relationship with Joyarti will be resolved by binding arbitration on an individual basis, except as described below.
The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, unless the parties agree otherwise.
You and Joyarti agree that disputes will be resolved only on an individual basis.
You and Joyarti waive the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding.
This arbitration agreement does not prevent either party from bringing an eligible claim in small claims court.
This arbitration agreement also does not prevent either party from seeking temporary or injunctive relief for intellectual property misuse, unauthorized access, security issues, or misuse of the Services.
You may opt out of this arbitration agreement within 30 days after first accepting these Terms by emailing support@joyarti.com with the subject line “Arbitration Opt-Out” and including your name, account email, and mailing address.
If any part of this arbitration section is found unenforceable, the remaining parts will continue to apply to the maximum extent permitted by law.
24. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
To the extent a dispute is not subject to arbitration, any dispute arising from or relating to these Terms or the Services will be handled in the state or federal courts located in California, unless applicable law requires otherwise.
Nothing in this section limits any rights you may have under applicable consumer protection laws.
25. Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be posted on this page with a new “Last updated” date.
Your continued use of Joyarti after the updated Terms take effect means you accept the updated Terms, except where applicable law requires a different form of notice or consent.
